Please read the full terms below. These are the points most people ask about.
1.1 Your membership agreement is with JNJ Leisure LTD, a company registered in England and Wales, company number 07257842, trading as UFit Fitness.
1.2 The club is run day to day by U Fit Community Leisure Ltd, company number 08447956, which employs all of the staff.
1.3 In these terms, "we", "us" and "UFit" means both companies and their staff. "You" means the member.
1.4 Our address is Unit 1B, Trident Park, Glass Avenue, Ocean Way, Cardiff CF24 5EN. Contact details are at clause 25.
2.1 Your agreement with us is made up of:
2.2 These terms deal mainly with joining, paying, freezing and leaving. The waiver deals mainly with safety, equipment, your health and CCTV. Where something is covered in detail in the waiver, these terms refer to it rather than repeat it.
3.1 Your agreement starts when you accept these terms at the end of the sign-up process, online or in the club.
3.2 Your membership starts on the date shown at sign-up. Before you train you must complete the Health and Gym Experience Questionnaire. If we ask you to have a review, GP clearance or an induction, you must not train unsupervised until that is done. The waiver explains this.
3.3 You must be at least 18 to take out a membership on your own. Anyone under 18 must join with a parent or guardian, and that parent or guardian must also be a member of the club. The parent or guardian completes the Health and Gym Experience Questionnaire, agrees to these terms and signs the waiver on the young person's behalf, and is responsible for the young person's payments. Members aged 16 and 17 may train on their own once the questionnaire has been completed and they have done any induction we ask for. Under-16s may only use the club as set out in the waiver. Under 18s may not use the sauna and ice recovery area.
3.4 We will email you a confirmation of your agreement, with a link to these terms, the Club Rules and the waiver. Please keep it.
3.5 Please tell us promptly if your name, address, email, phone number or bank details change.
4.1 Who this applies to. If you joined online, by phone, or anywhere other than in the club, you have a legal right to cancel within 14 days. This right does not apply if you joined in person at the club.
4.2 How long you have. You can cancel for any reason up to the end of the 14th day after the day you joined. You do not need to give a reason and the 90 days' notice in clause 10 does not apply.
4.3 How to cancel. Tell us clearly that you want to cancel, by email to membership@ufit-fitness.com, by post to the address in clause 25, by phone on 029 2048 6488, or in person at reception. You can use the model cancellation form at the end of these terms, but you do not have to. It is enough that you send your message before the 14 days end.
4.4 If you asked to start straight away. If you asked us to start your membership before the 14 days ended, and you then cancel within the 14 days, you must pay for the membership you had up to the day you told us you were cancelling. We work this out as a daily share of your monthly price.
4.5 Your refund. We will refund everything you have paid us, less any amount due under clause 4.4. We will refund you within 14 days of the day you tell us you are cancelling, using the same payment method you used, unless you agree otherwise. We will not charge you a fee for the refund. We will also cancel your direct debit.
4.6 Single visits and booked classes. If you buy a day pass or a class for a specific date, the 14-day right to cancel does not apply to it. See clause 17.
5.1 Your price. Your price is the price shown for your membership when you joined, as confirmed in your sign-up email. Current prices are on ufit-fitness.com. We do not put prices in these terms because they change for new members from time to time. A change for new members does not change your price. Your price can only change under clause 6.
5.2 First payment. Your first payment covers the period from your start date to your first direct debit date. The amount is shown before you confirm.
5.3 Monthly payments. After that, you pay the full monthly amount by direct debit each month, on the date shown at sign-up. Direct debits are set up through Glofox and collected by GoCardless on our behalf. You are protected by the Direct Debit Guarantee.
5.4 Paying whether or not you visit. Your membership continues, and payments stay due, whether or not you use the club, until your membership ends under clause 10, 12 or 13, or is frozen under clause 9.
5.5 Paying another way. If your direct debit is not working, staff may take your membership payment by card at reception. That counts as payment in the normal way.
5.6 Cancelling your direct debit is not the same as leaving. Cancelling your direct debit with your bank does not end your membership. To leave, tell us as set out in clause 10.
6.1 We may increase your monthly price. We will only do so for a valid reason, such as a rise in our running costs or a change in the facilities or services included in your membership.
6.2 We will give you at least 90 days' notice in writing before a new price starts. We will send it by email. It will say the new price and the date it starts.
6.3 If you do not want to pay the new price, you can leave. To leave you give us 90 days' notice (clause 10), and we give you at least 90 days' notice of any price increase. So if you give notice as soon as we tell you about the increase, your membership will end before the new price starts, and you will never pay it.
6.4 If you are already working through your 90 days' notice when a price increase is due, you keep your current price until your membership ends.
7.1 If a direct debit or other payment fails, we may try to collect it again.
7.2 We will contact you to arrange payment. You can pay by card at reception or in any other way we agree with you.
7.3 You remain responsible for any unpaid amount.
7.4 We do not charge an administration fee for a failed payment.
7.5 If a payment is still unpaid after we have tried to collect it, we will contact you. If it stays unpaid for 14 days, we may pause your door access until it is paid.
8.1 If an amount is unpaid, we will contact you about it, telling you how much is owed and how to pay it.
8.2 If it stays unpaid, we may pass the debt to a debt collection agency or take other lawful steps to recover it.
8.3 You will only ever be asked to pay the amount you owe. We do not add collection costs or charges.
8.4 We will not pass an amount to a debt collection agency while you have a complaint open with us about that amount.
9.1 You can freeze your membership for up to 3 months, for any reason. You do not need to give a reason or provide any evidence.
9.2 Freezing is free. While your membership is frozen, no monthly payments are taken and you cannot use the club.
9.3 To freeze, ask at reception or email membership@ufit-fitness.com at least 14 days before you want the freeze to start. You can take one freeze in any 12 months.
9.4 At the end of the freeze your membership restarts automatically and your monthly payments start again on your next payment date.
9.5 You cannot freeze your membership once you have given notice to leave. See clause 11.
10.1 There is no minimum term. You can give notice to end your membership at any time, including on the day you join.
10.2 You must give 90 days' notice. Your notice period starts on the day we receive your first email under clause 10.6 asking to end your membership. It does not start on the day we reply to you or deal with your request. Your membership ends at the end of the 90th day, unless clause 12 lets it end sooner.
10.3 During your notice period you keep full use of the club, and your monthly payments carry on as normal until your end date, on your usual payment date. Your final payment only covers the days up to that date, as set out in clause 10.4.
10.4 We will tell you exactly what is left to pay. No payment is taken on or after the date your membership ends. Your final payment only covers the period up to your end date. If you have already paid for any days after your end date, we will refund them within 14 days of your end date. When you give notice, we will confirm to you in writing the date your membership ends and the date and amount of your final payment.
10.5 There is no cancellation fee. You do not pay anything for leaving other than your normal monthly payments during the notice period.
10.6 How to give notice. Notice to end your membership must be given by email to membership@ufit-fitness.com. This means there is always a written, dated record of when you gave notice, for you and for us. If you tell a member of staff at reception that you want to leave, they will ask you to send the email and can help you do it there and then. Your notice starts on the day the email reaches us.
This clause is about ending your membership on 90 days' notice. It does not change how you can cancel within your first 14 days under clause 4, which you can do in any of the ways listed there.
10.7 We will send the confirmation in clause 10.4 by email within 14 days of receiving your first email asking to end your membership. Your notice period still counts from the day we received that first email, so if our reply takes longer, your notice period does not get any longer. If you do not receive the confirmation, please contact us, because it may mean we have not received your notice. Please keep the confirmation.
10.8 You can withdraw your notice at any time before your membership ends and carry on as a member.
10.9 Your direct debit will be cancelled after your final payment has been collected.
11.1 Once you have given notice to leave:
11.2 If you want to make a change that is not allowed during your notice period, you can withdraw your notice (clause 10.8) and make the change as a continuing member.
11.3 If, during your notice period, you become unable to exercise because of illness or injury, become pregnant, or are made redundant, clause 12 may let you leave sooner.
12.1 You can leave with 30 days' notice instead of 90, but only if you send us written evidence of one of the reasons below. We cannot give shorter notice on your word alone, and no other reason qualifies.
12.2 When the 30 days start. Your 30 days start on the day we accept your evidence. Shorter notice does not start until we have received and accepted it, and it does not count back to the day you gave notice. Your normal 90 days' notice still runs from the day you gave notice (clause 10.2). Your membership ends on whichever of those two dates comes first. When we accept your evidence, we will confirm in writing, within 14 days, the date we accepted it and your new end date. If you cannot get the evidence straight away, give notice anyway and send the evidence when you have it, so that your 90 days are already running.
12.3 We will only use your evidence to deal with your request. Health information is handled as set out in our Privacy Policy.
13.1 Serious breach. We may suspend your membership, or end it straight away by telling you in writing, if you seriously or repeatedly break these terms, the Club Rules or the waiver. Examples include violence, threats, theft, damaging property on purpose, harassment, using the club while under the influence of alcohol or drugs, letting someone else use your membership, or ignoring a staff instruction that is needed for safety.
13.2 For a less serious breach, we will normally give you a written warning first and a chance to put things right.
13.3 Unpaid amounts. If an amount remains unpaid for more than 90 days after we have contacted you under clause 8.1, we may end your membership by telling you in writing. You will still owe what was due up to the date your membership ends. We do not add any costs or charges.
13.4 Abuse, in person or online. We may suspend or end your membership if you abuse, threaten, harass or discriminate against our staff or other members, whether in person or online.
13.5 An honest review or complaint about UFit will never be a reason for us to suspend or end your membership.
13.6 If we suspend or end your membership under this clause 13, we will tell you why. If we end it, you do not have to give or pay for any notice period. We will refund, day by day, any payment you have made for a period when you do not have access to the club because of the suspension or ending. You remain responsible for anything you owed before then.
13.7 Ending for other reasons. We may end your membership for any other reason, for example if we stop offering your type of membership or close the club, by giving you at least 30 days' notice in writing. You will not pay for any period after your membership ends, and nothing is charged after that date.
13.8 If you think we have suspended or ended your membership unfairly, you can complain under clause 22.
14.1 Our opening hours, timetable and facilities are shown on ufit-fitness.com and in the club. We may change them for valid reasons, such as demand, staffing, maintenance or safety. We will give you reasonable notice of any significant change, unless it is outside our control.
14.2 Parts of the club may close at times, for example for cleaning, repairs, maintenance or events, or for reasons outside our control such as a power cut or severe weather. We will try to give advance notice.
14.3 If the whole club, or a main facility your membership includes, is closed for 7 days or more in a row, you can ask us for a refund or credit for that period, calculated day by day. If a significant change to the club makes your membership substantially worse, you can leave without giving 90 days' notice.
14.4 Classes, bookings and the use of individual areas are subject to availability and to the booking rules in the UFit app and the Club Rules.
15.1 You must follow the Club Rules, the waiver, signs in the club and staff instructions. The Club Rules and the waiver form part of this agreement.
15.2 The waiver covers the risks of exercise, safe use of equipment, your health and the health questionnaire, supervision and inductions, reporting hazards and injuries, personal belongings, CCTV, photography and junior members. Please read it carefully. You can ask for a copy of the waiver you signed at any time, at reception or by email to membership@ufit-fitness.com.
15.3 We may make reasonable changes to the Club Rules for safety, legal or operational reasons. The current version is always at ufit-fitness.com/club-rules and in the club. If a change to the Club Rules significantly affects what your membership gives you, clause 20 applies.
15.4 Your membership is personal to you. You get into the club using the UFit app. You must not let anyone else use your membership or your app.
16.1 Only personal trainers approved by UFit may coach or train anyone in the club. Anyone else training members may be asked to leave. If you want to train another person for payment, speak to management first.
16.2 All personal trainers at UFit are self-employed and run their own businesses. None is employed by UFit to deliver personal training. If you book sessions with one, your agreement for those sessions is with the trainer, not with us, and you pay the trainer directly. We are not responsible for the trainer's charges, cancellation policy or the way they run their business.
16.3 Clause 16.2 does not affect our responsibility for the club itself, for approving trainers, or anything else we cannot exclude by law (see clause 18).
17.1 These terms apply to day passes and class passes as far as they are relevant. Clauses 4, 9, 10, 11 and 12 do not apply to passes.
17.2 A pass is for the person named on it. A day pass or class pass is valid for 24 hours from the time you buy it. You can cancel a class booking up to 1 hour before the class starts and book another class instead. If you cancel within 1 hour of the start, or do not attend, the booking cannot be changed and a class pass counts as used.
17.3 Before training, every pass holder must accept the waiver and complete the Health and Gym Experience Questionnaire.
17.4 The legal 14-day right to cancel does not apply to a pass or class booked for a specific date. You may bring a guest, as long as they buy their own day pass through Glofox first, so they complete the questionnaire before they train. Clause 17.3 applies to them like any other pass holder.
18.1 Nothing in these terms, the Club Rules or the waiver limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit or exclude.
18.2 We will provide our services with reasonable care and skill. If we do not, you have legal rights. Nothing in these terms affects those rights. You can get advice from Citizens Advice.
18.3 Subject to clause 18.1, the waiver explains what you are responsible for when you train, and the situations in which we are not responsible, such as injuries caused by misusing equipment or by ignoring rules or instructions. Those parts of the waiver apply as part of this agreement.
18.4 We are not responsible for loss or damage that was not a foreseeable result of our breach of these terms or our negligence. We are not responsible for business losses.
18.5 We are not responsible for loss of or damage to your belongings, unless it was caused by our negligence or our breach of these terms. Please use a locker, with your own padlock, and do not leave valuables unattended.
18.6 If you damage our equipment or property through misuse, a deliberate act or your own negligence, we may ask you to pay the reasonable cost of repair or replacement, as the waiver says.
19.1 JNJ Leisure LTD holds the personal information you give us, including your health questionnaire, and makes it available to staff employed by U Fit Community Leisure Ltd who need it to run the club. Our Privacy Policy at ufit-fitness.com/privacy-policy explains what we collect, why, how long we keep it and your rights.
19.2 We will only send you marketing if you have agreed to it. You can opt out at any time.
20.1 We may change these terms for valid reasons: to reflect a change in the law or regulatory guidance, to reflect changes in how we run the club or take payments, to make them clearer, or to correct mistakes.
20.2 If a change is to your disadvantage, we will give you at least 90 days' notice in writing, by email, before it takes effect. If you do not want to accept it, you can give notice to leave (clause 10). If you give notice as soon as we tell you about the change, your membership will end before the change takes effect.
20.3 Changes that do not disadvantage you, such as correcting mistakes or making wording clearer, take effect when we publish the updated terms at ufit-fitness.com/terms.
20.4 Price changes are dealt with under clause 6.
21.1 We may transfer our rights and obligations under this agreement to another business, for example if the club is sold. We will tell you in writing. We will make sure the transfer does not reduce your rights under these terms.
21.2 You cannot transfer your membership to anyone else, at any time.
22.1 If you are unhappy, please speak to a member of staff or the general manager first. Most things can be sorted out quickly that way.
22.2 If that does not resolve it, email membership@ufit-fitness.com or write to us at the address in clause 25, with details of your complaint. We will acknowledge it within 14 days and aim to give you a full response within 28 days. Complaints about how we use your personal information are handled under our Privacy Policy.
22.3 We do not currently use an alternative dispute resolution scheme. If you are not happy with our response, you can contact Citizens Advice for free, independent advice, or you can take your complaint to court.
23.1 If we do not enforce a term straight away, or give you extra time to pay or do something, we can still enforce it later.
23.2 If a court or regulator decides that any part of these terms is unlawful or unenforceable, the rest of the terms still apply.
23.3 If any wording in these terms could have more than one meaning, the meaning most favourable to you applies.
24.1 These terms are governed by the law of England and Wales.
24.2 You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
